1. Introduction

The Promotion of Access to Information Act 2 of 2000 (PAIA) gives effect to the constitutional right of access to information held by public and private bodies where that information is required for the exercise or protection of a right.

This manual explains what records are held by Chrisnadri Investments (Pty) Ltd trading as Jo’s Dreamland, how those records may be accessed and how Jo’s Dreamland processes and protects personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

This manual is intended to help members of the public:

  • understand whether information may be processed outside South Africa; and

  • understand the measures taken to protect personal information.

5. PAIA Guide

The Information Regulator has published a guide explaining how PAIA works and how individuals may exercise their rights under PAIA and POPIA.

The guide is available from the Information Regulator (South Africa) and may also be requested from the Jo’s Dreamland Information Officer.

6. Records Available Without a Formal PAIA Request

Certain Jo’s Dreamland information is publicly available without submitting a formal PAIA request.

  • Shipping & Delivery Policy;

  • Returns & Refunds Policy;

  • customer help and FAQ information;

  • contact information;

  • blog articles and other publicly published content; and

  • marketing or social media content made publicly available by Jo’s Dreamland.

Publicly available website records may be accessed directly through the Jo’s Dreamland website.

7. Records Maintained in Accordance With Other Legislation

Where applicable, Jo’s Dreamland may hold:

9. How to Request Access to a Record

A person requesting access to a record under PAIA must complete the prescribed Form 2: Request for Access to Record and submit it to the Information Officer.

Because Jo’s Dreamland is a private body, a requester must identify the right they wish to exercise or protect and explain why the requested record is reasonably required to exercise or protect that right.

Sufficient information should be provided to allow Jo’s Dreamland to identify the requester and the record being requested.

Proof of identity and, where a request is made on behalf of another person, proof of authority to act on that person’s behalf may be required.

Prescribed PAIA fees may apply where permitted by law.

Access to a record may be refused where one of the lawful grounds for refusal provided for in PAIA applies.

10. Complaints Regarding PAIA Requests

If a requester is dissatisfied with the outcome of a PAIA request, or Jo’s Dreamland does not respond within the period prescribed by PAIA, the requester may lodge a complaint with the Information Regulator (South Africa) using the prescribed Form 5 or seek any other remedy available under applicable law.

11. Processing of Personal Information

Jo’s Dreamland processes personal information for legitimate business and legal purposes, including:

  • processing and fulfilling customer orders;

  • accepting and administering payments;

  • arranging deliveries;

  • handling returns, refunds and exchanges;

  • responding to customer enquiries;

  • maintaining customer and transaction records;

  • operating and improving the Jo’s Dreamland website;

  • preventing fraud and maintaining website security;

  • conducting accounting and financial administration;

  • communicating with suppliers and service providers;

  • marketing Jo’s Dreamland products where permitted by law; and

  • complying with legal, regulatory and contractual obligations.

Suppliers & Service Providers

Information may include:

  • names and contact details;

  • company registration and VAT information;

  • banking and payment information;

  • contracts and correspondence; and

  • invoicing records.

Employees & Contractors

Where applicable, information may include:

  • identity and contact information;

  • employment or contractor records;

  • banking and payment information;

  • tax information; and

  • information required to administer the employment or contractual relationship.

13. Recipients of Personal Information

Personal information may, where necessary and lawful, be supplied to categories of recipients including:

  • payment processors;

  • courier and delivery providers;

  • ecommerce and website technology providers;

  • accounting and financial service providers;

  • email and customer communication platforms;

  • analytics and advertising service providers;

  • insurers and professional advisers;

  • IT and cloud service providers; and

  • regulatory, government or law-enforcement authorities where disclosure is required by law.

Only information reasonably necessary for the relevant purpose will be shared.

14. Cross-Border Processing of Personal Information

Some technology, ecommerce, cloud, analytics, marketing or other service providers used by Jo’s Dreamland may store or process personal information outside the Republic of South Africa.

Where personal information is transferred outside South Africa, Jo’s Dreamland will take reasonable steps to ensure that the transfer complies with POPIA and that appropriate safeguards or other lawful grounds for the transfer are in place.

15. Information Security

Jo’s Dreamland takes reasonable technical and organisational measures to safeguard personal information against loss, unauthorised access, misuse, alteration or disclosure.

Measures may include, where appropriate:

  • password-protected systems and account controls;

  • access restrictions;

  • secure ecommerce and payment systems;

  • encryption and secure transmission technologies;

  • reputable cloud and technology service providers;

  • software and system security measures;

  • backup and recovery measures;

  • limiting access to personal information to persons who require it for legitimate business purposes; and

  • appropriate contractual arrangements with service providers processing personal information on behalf of Jo’s Dreamland.

Security measures are reviewed and updated where reasonably necessary.

This PAIA Manual is available:

  • on the Jo’s Dreamland South Africa website;

  • electronically from the Information Officer upon request; and

  • as otherwise required under applicable law.
